Would this break the law and how would it affect the web designer?
If the person or company has made it clear that their video is copyrighted then they are likely to take legal action. If someones video is copyrighted and you are ignoring that fact, then you are eligible to be taken to court which will most likely result in a hefty fine. If you were to post a film online, then that film company will be able to sue you an awful lot of money as they will have many lawyers and a lot of power. However, if the video is not copyrighted and you are able to prove that, then the person is not able to do a thing.

They are liable and the person who owns the video can sue.
It is a different scenario if they build it for someone else and that someone else provided it to be published. Then that someone else is liable
